Namely, D8 is present in trace amounts in the hemp plant (less than 0.1%) naturally. Because it’s found in the plant in such low concentration, manufacturers would have to use tons of hemp plant materials to extract a tiny amount of this compound. 

This issue made them resourceful as labs started converting hemp-derived cannabidiol (CBD) into delta 8 THC by using isomerization. This method of creating D8 forms a potential conflict with a regulation of the Drug Enforcement Agency (DEA). 

In August 2020, the DEA issued an Interim Final Rule which stated that “all synthetically derived tetrahydrocannabinol remains a Schedule I controlled substance.”

The interim rule doesn’t exactly define what the term “synthetic” encompasses. Therefore, experts are debating if delta 8 THC made using isomerization (converting one cannabinoid into another) falls under the category of a “synthetic” drug.
